Quiznos class-actions: One fails in Canada, one moves forward in Colo.

TORONTO A superior court judge here recently denied a request by a group of Quiznos franchisees to form a class-action suit, ruling that all 427 Canadian franchisees did not qualify to band together in suing the Canadian franchisor of the Denver-based sub sandwich chain.

The suit, filed in 2006, accused Quiznos Canada Restaurant Corp. of price gouging franchisees on supply costs yet limiting what they could charge customers.

Meanwhile in Denver, a federal judge on Thursday declined a request from Quiznos to deny class-action status to a lawsuit brought by a group of franchisees.

Quiznos is the franchisor of more than 5,000 sandwich shops around the globe. The U.S. District Court decision comes four months after a federal judge in Wisconsin threw out a lawsuit filed on behalf of Quiznos franchisees. Those franchisees filed a new lawsuit in Wisconsin state court late last month.

The American lawsuits have been similar to the Canada suit with franchisees alleging fraud and breach of contracts.

Quiznos has denied any wrongdoing in all of the legal actions.
